Butte residents plead not guilty in boot assault case

Two Butte residents have pleaded not guilty to assault with a weapon for allegedly beating and kicking a man with their boots.

Sara Lynn Palmer, 31, and Charles William Mizenberg, 46, were arraigned on charges Thursday.

According to court documents, the alleged incident took place on Monday, Feb. 1 at a residence on the 700 block of South Utah Avenue just before 8 p.m.  They are accused of causing bodily injury to another individual using boots as the weapon. 

The victim was hospitalized for several days for treatment of injuries, according to the county attorney's office.

Palmer and Mizenberg were returned to the custody of the sheriff in lieu of a $50,000 bond. 

Public defenders were ordered to appoint new council for Mizenberg.

An omnibus hearing was set for Thursday, April 1 for the pair.
