A complaint has been filed in Butte-Silver Bow District Court regarding a decision by council to demolish the Greek Café Building in uptown Butte.
The complaint was filed Thursday afternoon by attorney Susan Callaghan on behalf of Butte Citizens for Preservation and Revitalization, and three individuals. According to the complaint those individuals are Mark Reavis, Nicole Von Gaza, and Richard Gibson. The complaint seeks declaratory judgment asking the court to determine if Butte-Silver Bow and the Butte-Silver Bow Council of Commissioners violated open meeting and public participation statues. It also asks the court to determine if they violated provisions of the historic preservation commission ordinance.
During a council meeting Wednesday evening commissioners discussed at length letters from Callaghan and the U.S. Department of the Interior asking them to set aside earlier votes to demolish the building.
After a debate over whether or not those previous votes were carried out legally commissioners voted to note and place the letters on file. They did NOT decide to reconsider their earlier demolition votes.
A contract has been signed with Hoffman's R and M Services of Butte to demolish the building. Demolition is set for October 11th. Reavis is hoping the complaint leads to an injunction that halts the demolition.
